The fine print, in plain English
Terms of Service
These terms cover your use of the Beacon website and services. We’ve kept them short and readable — no games. If anything here is unclear, ask us before you rely on it.
1. Who we are
Beacon and Mayday are services of DayLight Creative Technologies, LLC(“DayLight,” “we,” “us,” or “our”), a Texas limited liability company based in Tyler, Texas, USA. This website lives at beacon.daylightcreative.tech.
2. What these terms cover
These Terms of Service (the “Terms”) apply to your use of this website and to the services we offer through it. If you enter into a separate written engagement or in-portal agreement with us for a specific service, that agreement governs where it conflicts with these Terms. By using the site, you agree to these Terms; if you don’t agree, please don’t use it.
3. Using the site vs. hiring us
Browsing this site and sending us a form does not, by itself, create a service contract or a client relationship. It starts a conversation. A paid engagement begins only when we both agree to it — for Beacon, when you start a subscription; for a Mayday rescue, when you approve the plan and remediation begins; for Compass, Harbor, or custom work, when you accept the quote or engagement.
4. Our services
Summarized here; the specifics of what you get are set out on our pricing page and in your engagement:
- Beacon — ongoing WordPress care: updates, hardening, monitoring, and backups on a monthly subscription.
- Mayday — a one-time hack rescue that starts with a free, no-obligation assessment and written report.
- Compass & Harbor — domain and DNS locating, setup, and fixes.
- Custom work — selective design/development, quoted per project.
5. Security is care, not a guarantee
We take reasonable, professional care to keep sites updated, hardened, monitored, and backed up. But no one can guarantee that a website will never be compromised, and we don’t make that promise. Beacon reduces risk and, if a site under active Beacon coverage is compromised, covers the cleanup — it is a care and rescue service, not a warranty or an insurance policy against every possible attack, data loss, or downtime.
6. Your responsibilities
- Give us accurate information, and keep your contact details current.
- Only ask us to work on sites, domains, and accounts you own or are authorized to manage, and only share credentials you’re permitted to share.
- You’re responsible for your own website content and for using our services lawfully.
- Keep your own copies of anything important to you; we maintain backups as part of the service, but you shouldn’t rely on us as your only copy.
7. Credentials & access
When a job needs your passwords or access credentials, you hand them over through a secure, one-time-view channel — never by email. We describe exactly how this works before you send anything. You’re responsible for rotating credentials you believe may have been exposed, and we’ll recommend rotation after a rescue.
8. Third-party services
The sites we care for run on third-party infrastructure — web hosts, domain registrars, WordPress, plugins, and themes — that we don’t own or control. We help you work with and around those services, but we’re not responsible for their outages, pricing, policy changes, or vulnerabilities. This website itself relies on third-party providers (see our Privacy Policy).
9. Fees, billing & refunds
Prices are shown on our pricing page and confirmed in your engagement. Beacon is a recurring monthly subscription; Mayday is split into a deposit and a balance due on delivery. When online payment is enabled, we process payments through Stripe and don’t store your full card details ourselves. What’s refundable and how to cancel is set out in our Refund & Cancellation Policy, which is part of these Terms.
10. Intellectual property
The content, design, and marks on this site — including “Beacon,” “Mayday,” “Compass,” and “Harbor” as used here — belong to DayLight. Your own content and materials remain yours; you grant us the access and permission we need to perform the services you ask for.
11. Disclaimers
To the fullest extent permitted by law, the website and services are provided “as is” and “as available,” and we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the site will be uninterrupted or error-free, or that any particular security outcome will be achieved.
12. Limitation of liability
To the fullest extent permitted by law, DayLight will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the services is limited to the amount you paid us for the service giving rise to the claim during the three (3) months before the claim arose. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.
13. Your indemnification
You agree to indemnify and hold DayLight harmless from claims arising out of your website content, your unlawful use of the services, or your breach of these Terms — for example, asking us to work on a site or account you weren’t authorized to access.
14. Governing law & disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Smith County, Texas, and you consent to their jurisdiction. Nothing here limits rights you may have that cannot be waived under applicable law.
15. Changes to these terms
We may update these Terms from time to time. When we do, we’ll revise the “last updated” date above. Material changes take effect when posted, and your continued use of the site after that means you accept the updated Terms.
16. Contact
